Welcome to AppointGreen. These Terms & Conditions ("Terms") govern your use of the AppointGreen platform, website, and services. By creating an account or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use AppointGreen.

1. Definitions

• "Platform" refers to the AppointGreen website and all related services.
• "Landlord" refers to a user who creates a landlord account to send rental application or lease signing requests.
• "Renter" refers to a user who creates a renter account to complete and submit applications.
• "Application" refers to a rental application or lease signing request processed through the Platform.

2. Account Registration & Types

2.1 Eligibility

You must be at least 18 years old to create an account. You must provide accurate and complete information during registration.

2.2 Account Types

AppointGreen offers two account types:

• Landlord Account: Allows you to send application requests, review submissions, and approve or reject applications.
• Renter Account: Allows you to receive and complete application requests, upload photos and signatures, and pay fees.

You may only create one type of account per email address. You are responsible for maintaining the confidentiality of your password.

2.3 Email Verification

All accounts require email verification. You must verify your email address before accessing platform features.

3. Landlord Obligations

By using AppointGreen as a landlord, you agree to the following:

• Legitimate use only: You will only use the platform for legitimate rental applications for real properties you own or are authorized to manage.
• Accurate information: All property details, rent amounts, and application fees you set must be accurate and truthful.
• Fair housing compliance: You agree to comply with all applicable fair housing and anti-discrimination laws when reviewing applications.
• Responsible data handling: You will handle renter personal data, photos, and signatures confidentially and only for the purpose of evaluating the rental application.
• No misuse: You will not use the platform to collect personal information under false pretenses, for identity theft, or for any unlawful purpose.
• Application fees: Any application fee you charge must comply with applicable local laws regarding fee limits and refundability.

4. Renter Obligations

By using AppointGreen as a renter, you agree to the following:

• Recognized applications only: You will only submit information for real rental applications you recognize and have initiated with a legitimate landlord.
• Accurate information: All information you provide must be accurate and complete to the best of your knowledge.
• Identity verification: The live photo you provide must be a genuine photo of yourself. Using someone else's identity is strictly prohibited.
• Binding signature: Your digital signature is legally binding. By signing, you confirm the accuracy of your application.
• Payment authorization: You authorize the application fee charge and understand fees are typically non-refundable.
• No fraud: You will not use the platform to submit fraudulent applications or misrepresent your identity.

5. Digital Signatures

Digital signatures created through AppointGreen are intended to be legally binding electronic signatures under applicable electronic signature laws (such as the U.S. ESIGN Act). By using the signature feature, you consent to conducting transactions electronically. Your signature:

• Confirms the accuracy of the information in your application
• Is timestamped and recorded with your consent
• Has the same legal effect as a handwritten signature where permitted by law

6. Application Fees & Payments

• Application fees are set by the landlord and displayed before payment.
• Payments are processed by third-party PCI-compliant payment gateways (e.g., Stripe, PayPal).
• AppointGreen does not store card details.
• Application fees are generally non-refundable once submitted, unless required by local law or at the landlord's discretion.
• Disputes regarding fees should first be directed to the landlord, then to our support team.

7. Acceptable Use Policy

You agree not to:

• Use the platform for any unlawful, fraudulent, or deceptive purpose
• Impersonate another person or entity
• Send application requests for properties you do not own or manage
• Submit false or misleading information
• Attempt to access another user's account or data
• Interfere with the platform's security or operation
• Use bots or automated systems to access the platform without authorization
• Collect or harvest personal data of other users

8. Privacy & Data Protection

Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using AppointGreen, you consent to the data practices described in our Privacy Policy.

9. Consent for Photo & Signature Collection

AppointGreen requires explicit consent (via checkbox) before collecting any renter photo or signature. This consent confirms that the renter understands:

• Why the photo is being collected (identity verification)
• Why the signature is being collected (legal confirmation of accuracy)
• Who will see the data (the reviewing landlord)
• How the data is stored (encrypted, not sold)

10. Activity Logging

AppointGreen maintains activity logs for both landlords and renters. These logs record actions such as logins, request creation, form submissions, status changes, and payment events. Logs are used for security, auditing, and dispute resolution.

11. Intellectual Property

The AppointGreen platform, including its design, branding, and software, is the property of AppointGreen and is protected by intellectual property laws. You may not copy, modify, or distribute our platform without authorization.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for downtime or data loss beyond our control.

13. Limitation of Liability

AppointGreen is a platform facilitating connections between landlords and renters. We are not a party to any lease agreement and are not responsible for:

• The accuracy or truthfulness of information provided by users
• Decisions made by landlords to approve or reject applications
• The legality or enforceability of any lease agreement
• Any damages arising from the landlord-renter relationship

To the maximum extent permitted by law, AppointGreen's liability is limited to the application fees processed through the platform.

14. Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform.

These Terms are governed by the laws of the jurisdiction in which AppointGreen operates, without regard to conflict of law principles. Any disputes will be resolved in the appropriate courts of that jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes via email or a prominent notice on the platform. Continued use after changes constitutes acceptance of the updated Terms.
